These Terms of Service ("Terms") govern your access to and use of HomePot, available at https://homepot.sendhome.online and operated by SENDHOME.ONLINE LTD ("HomePot", "we", "our", or "us").
By accessing or using HomePot, you agree to be bound by these Terms.
1. About HomePot
HomePot is a self-custodial software wallet designed to help users hold and manage USD Coin (USDC) on the Polygon network.
HomePot provides software only.
HomePot does not:
- Custody customer fiat funds.
- Custody customer digital assets.
- Hold private keys or recovery phrases.
- Execute transactions on behalf of users.
All blockchain transactions are initiated and authorised by users from their own devices.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use HomePot.
You are responsible for ensuring that your use of HomePot complies with all laws and regulations applicable in your jurisdiction.
3. Self-Custody and Wallet Security
HomePot is a self-custodial wallet.
By using HomePot, you acknowledge and agree that:
- You control your wallet credentials and recovery information.
- You are solely responsible for safeguarding your device, password, private keys, recovery phrases, and backup information.
- HomePot cannot recover lost private keys, passwords, or recovery phrases.
- HomePot cannot reset wallet access.
- HomePot cannot reverse or cancel blockchain transactions.
- Blockchain transactions are generally irreversible once confirmed by the network.
Loss of wallet credentials may result in permanent loss of access to your digital assets.
4. Supported Assets and Networks
HomePot is designed primarily for USDC on the Polygon network.
Unless expressly stated otherwise within the application, HomePot does not guarantee support for any other blockchain network, token, or digital asset.
You are solely responsible for ensuring that assets are sent to compatible wallet addresses and networks.
5. Third-Party Services
HomePot may integrate with independent third-party service providers, including:
- Fiat-to-crypto on-ramp providers.
- Payment service providers.
- Blockchain infrastructure providers.
- Analytics and monitoring providers.
Where available, purchases of USDC are facilitated by independent third-party providers.
Those providers are solely responsible for:
- Identity verification and compliance checks.
- Payment processing.
- Pricing and fees.
- Transaction execution.
- Service availability.
- Regulatory compliance.
Your use of third-party services is governed by their own terms, privacy policies, and legal requirements.
HomePot does not custody fiat currency during any on-ramp transaction.
6. Fees
HomePot may introduce optional fees for certain features in the future.
Any HomePot fees will be disclosed before use.
Blockchain network fees, payment processing fees, and third-party provider fees are separate from any fees charged by HomePot.
7. Digital Asset Risks and No Advice
Digital assets, blockchain networks, and related technologies involve risks, including:
- Loss of access to assets.
- User error.
- Smart contract failures.
- Network failures or congestion.
- Third-party service interruptions.
- Regulatory changes.
- Irreversible transactions.
HomePot does not provide:
- Financial advice.
- Investment advice.
- Legal advice.
- Tax advice.
- Accounting advice.
Any information provided through HomePot is for informational purposes only.
You are solely responsible for evaluating the risks associated with your use of digital assets and blockchain technology.
8. Acceptable Use
You agree not to:
- Use HomePot for unlawful purposes.
- Attempt to bypass security controls.
- Interfere with or disrupt HomePot systems.
- Use HomePot in connection with fraud, money laundering, sanctions violations, terrorist financing, or other unlawful activities.
- Reverse engineer, exploit, or misuse the service.
We may restrict or suspend access where reasonably necessary to comply with law, protect users, or maintain the security and integrity of HomePot.
9. Availability
We do not guarantee uninterrupted or error-free access to HomePot.
HomePot may be modified, suspended, restricted, or discontinued at any time where reasonably necessary for:
- Security.
- Maintenance.
- Operational requirements.
- Legal or regulatory obligations.
- Third-party service changes.
You should maintain independent backups and recovery methods for your wallet.
10. Limitation of Liability
To the maximum extent permitted by applicable law, SENDHOME.ONLINE LTD shall not be liable for:
- Loss of digital assets.
- Loss of wallet credentials.
- Loss resulting from user error.
- Blockchain network failures or congestion.
- Third-party provider failures.
- Loss of profits, revenue, business opportunities, or data.
- Indirect, incidental, consequential, special, or punitive damages.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
11. Indemnity
You agree to indemnify and hold harmless SENDHOME.ONLINE LTD and its directors, officers, employees, contractors, and affiliates from claims, losses, liabilities, and expenses arising from:
- Your use of HomePot.
- Your breach of these Terms.
- Your violation of applicable law.
12. Changes to These Terms
We may update these Terms from time to time.
Updated versions will be published on HomePot and become effective upon publication.
Your continued use of HomePot after publication of revised Terms constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have jurisdiction over disputes arising from these Terms, subject to any mandatory consumer rights that apply in your jurisdiction.
